Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and Agile Rocket Software PLLC (“Floofurz”, “we”, “us”), governing your use of the Floofurz website and application (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a business, you represent that you have authority to bind it.

1. The Service

Floofurz is business-management software for professional pet-sitting operations. It provides tools for client and pet records, scheduling, visit reporting, a client portal, and invoicing. Floofurz is software; we do not provide pet-care services, we do not employ or supervise sitters, and we are not a party to the arrangement between you and your clients.

2. Accounts

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for the accuracy of your account information and for keeping your credentials secure.
• You are responsible for everything that happens under your account, including actions by sitters and staff you invite.
• Tell us promptly at support@floofurz.com if you suspect unauthorized access.

3. Your data

You own the data you put into Floofurz. You grant us the limited right to host, process, and transmit it as needed to operate the Service on your behalf, and to create backups. We do not use your business data to advertise to you, and we do not sell it.

You are responsible for having the right to enter the information you upload — including information about your clients, their pets, and their homes — and for handling it in line with applicable law and any promises you have made to them. Our Privacy Policy explains our respective roles in more detail.

4. Subscriptions and billing

• Paid plans are billed in advance on a recurring monthly basis at the rates published on our pricing page, plus any usage above the stated fair-use allowances.
• Subscriptions renew automatically until cancelled. You may cancel at any time, effective at the end of the current billing period.
• Fees are non-refundable except where required by law or where we state otherwise in writing.
• We may change prices on at least 30 days' notice. A price change takes effect at your next renewal, and you may cancel before it applies.
• If a payment fails we may suspend access until the balance is settled.
• Fees exclude taxes. You are responsible for any taxes other than those on our income.

5. Payments to you

Floofurz uses Stripe to let your clients pay you by card. To accept card payments you must open and maintain your own Stripe account and agree to Stripe's terms. Payments made by your clients settle directly to your Stripe account.

Floofurz does not hold, transmit, or take a percentage of those funds, and is not the merchant of record for them. You are responsible for the goods and services you sell, for refunds and chargebacks, and for the accuracy of what you invoice. Stripe charges its own processing fees directly to you. Because a payment, refund, or dispute can be handled in your own Stripe dashboard, records in Floofurz may not always reflect the latest state at Stripe; Stripe is authoritative for money movement.

6. Acceptable use

You agree not to:

• Break the law or infringe anyone's rights using the Service.
• Upload malware, attempt to breach or probe our security, or access another organization's data.
• Reverse engineer, resell, or white-label the Service except as we expressly permit.
• Send unlawful, deceptive, or unsolicited messages through the Service, or send text messages to anyone who has not consented to receive them.
• Interfere with the Service's operation, or place unreasonable load on it.

You are responsible for obtaining consent from your clients before sending them text messages through Floofurz, and for honoring their opt-outs.

7. Availability and support

We work to keep Floofurz available and reliable, but we do not promise uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice where practical. Planned maintenance, third-party outages, and events beyond our control can affect availability.

8. Our intellectual property

The Service, including its software, design, and trademarks, belongs to us and our licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing, and nothing more. Feedback you send us may be used without obligation to you.

9. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate an account that breaches these Terms, creates risk or legal exposure, or is inactive with an unpaid balance. Where circumstances allow, we will give notice and an opportunity to fix the problem first.

After termination you may export your data for a reasonable period, on request, after which we may delete it in line with our Privacy Policy.

10. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that it will meet your requirements.

Floofurz is a record-keeping and scheduling tool, not a substitute for your own professional judgement. You remain responsible for the care you provide, for verifying schedules and instructions, and for the welfare of the animals in your care.

11. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to these Terms or the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnity

You will defend and indemnify us against claims, losses, and reasonable costs arising from your use of the Service, your data, your breach of these Terms, or your relationship with your clients and sitters.

13. Changes to these Terms

We may update these Terms. For material changes we will give reasonable notice — by email or in the application — before they take effect. Continuing to use the Service after that means you accept the revised Terms.

14. Governing law and disputes

These Terms are governed by the laws of the United States and of the state in which Agile Rocket Software PLLC is organized, without regard to conflict of law rules. The parties will try in good faith to resolve any dispute informally first; write to us at support@floofurz.com.

15. General

These Terms, together with the Privacy Policy, are the entire agreement between us on this subject. If a provision is unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets.
